1. Community Solar Participation

1.1. Eligible Participants

This program is open to all Piedmont Electric members who are in good standing, as defined in Piedmont Electric’s Service Rules and Regulations.

1.2. Member Allocated Multiplier

Your share of the Community Solar program will be based on:
Number of panels you subscribe to ÷ 1,854 total panels = Your Capacity Multiplier

1.3. Solar Energy Credits

Piedmont Electric will give the Member Solar Energy Credits on their monthly bill for the service address and account number listed. These credits are based on the Member’s share (Allocated Capacity) of power made at Piedmont Electric’s solar farms in Person County and Caswell County. The solar farms are owned by Member EMC Solar Two, LLC (“Solar Farm Owner”).

1.4. Unlimited Panel Subscriptions

Members may subscribe to the solar energy output for as many panels as they wish.

1.5. Environmental Attributes

The Member understands and agrees that Piedmont Electric buys all solar energy and all Environmental Attributes from the Solar Farm Owner. These Environmental Attributes belong only to Piedmont Electric. The Member agrees not to claim ownership of them or say anything different.

“Environmental Attributes” means all rights, credits, or benefits that come from how clean or renewable the solar energy is. This includes things like avoided pollution or greenhouse gases, renewable energy credits (RECs), and any similar programs created now or in the future by government or industry groups.

2. Consideration (Payment)

For the Member to receive Solar Energy Credits under this Agreement, the Member will pay Piedmont Electric $2.50 per panel per month, based on the number of panels listed in Section 1.2. This charge will be added to the Member’s monthly electric bill.

3. Term (Length of Agreement)

This Agreement starts on the first full month after it is signed. It will continue until 1) the program ends, 2) the Member tells Piedmont Electric they want to stop participating, or 3) electric service to the Member ends.

4. Solar Energy Credit

4.1. How the Credit Is Calculated
Each month, the Member will receive a Solar Energy Credit based on:

Their Allocated Capacity Percentage (from Section 1.2), multiplied by the total solar energy (kWh) produced by Piedmont Electric’s solar farms the previous month, multiplied by the current energy credit rate from Piedmont Electric’s Small Qualifying Facilities Purchased Power (SQF) Rate Schedule.

4.2. Credit Application

Piedmont Electric’s only responsibility is to apply the Solar Energy Credits to the Member’s monthly electric bill.

4.3. No Tax Credits

Members understand they cannot claim any federal or state tax credits for joining this program.

5. Additional Agreements

5.1. No Access or Ownership

Members cannot enter the solar farms for any reason. Members do not own or control any part of the solar farms and have no responsibility for operating or maintaining them. This Agreement does not give the Member any property rights of any kind.

5.2. No Warranties

All warranties about the solar farms—equipment, performance, or energy output—are disclaimed. This includes all implied warranties of merchantability or fitness for a particular purpose.

5.3. No Changes to Electric Service Terms

Nothing in this Agreement changes any rate, charge, rule, or condition of regular electric service. All of Piedmont Electric’s rates, terms, and policies can still change according to law or Piedmont Electric’s bylaws.

5.4. Force Majeure

If something outside Piedmont Electric’s control (a “Force Majeure” event) reduces or stops solar energy production such as storms or natural disasters, Piedmont Electric is not at fault.

During a Force Majeure event, Piedmont Electric does not have to: continue applying Solar Energy Credits, or find another source of solar energy to replace lost production. Piedmont Electric will resume normal duties once the solar farms are repaired or restored.
